1. Who we are

These Terms & Conditions ("Terms") govern your use of the products and services (the "Service") provided by the PM app ("we", "us", "our"). By accessing, creating an account on, or continuing to use the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Notice. If you do not agree, you must not use the Service.

2. Acceptance and continued use

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you are using it as an individual, you confirm you are of legal age in your jurisdiction. Your continued use of the Service after any update to these Terms constitutes your acceptance of the updated Terms.

3. Acceptable use

You agree not to misuse the Service. You must not:

  • use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  • engage in fraud, spam, or deceptive practices;
  • infringe any intellectual property, privacy, or other rights of any third party;
  • interfere with the security or integrity of the Service, including by introducing malware, probing, scanning, or scraping; or
  • circumvent technical limits or access controls.

4. Account & credentials

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it up to date.

5. Intellectual property

The Service, including all software, documentation, branding, and related materials, is owned by the PM app and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your subscription plan. You may not reverse engineer, resell, redistribute, or circumvent technical limits of the Service.

6. Your content

You retain ownership of any content you submit to the Service ("Customer Content"). You grant us a limited, worldwide, royalty-free license to host, store, transmit, process, and display Customer Content solely to provide, secure, and improve the Service for you, including by routing it to AI subprocessors when you use AI features (see section 7).

You represent and warrant that you have all rights, consents, and authority necessary to submit Customer Content to the Service and to permit the processing described in these Terms, and that Customer Content does not infringe or violate the rights of any third party or any applicable law.

7. AI features

The Service includes optional AI-powered features (collectively, "AI Features") such as feedback clustering and triage, quick-capture routing, OKR and strategy suggestions, vendor and competitor enrichment, project summarisation, and competitor news summarisation. AI Features are powered by third-party large language model providers accessed via the Lovable AI Gateway.

  • How AI Features work. When you invoke an AI Feature, the relevant Customer Content is sent to a third-party model provider solely to generate the requested output ("AI Output"). We have contractual arrangements with our subprocessors that prohibit them from using your Customer Content to train their foundation models.
  • Probabilistic outputs. AI Output is generated probabilistically and may be inaccurate, incomplete, out of date, biased, offensive, or otherwise unsuitable. AI Output does not constitute professional advice (legal, financial, medical, security, or otherwise).
  • Your responsibility. You are solely responsible for reviewing, validating, and deciding whether to use any AI Output. You must not rely on AI Output as the sole basis for any decision that has legal, financial, safety, or other material consequences. Any action you take based on AI Output is at your own risk.
  • No warranty for AI Features. AI Features are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, regarding AI Output, including warranties of accuracy, fitness for a particular purpose, non-infringement, and originality.
  • Indemnity for AI inputs. You will defend, indemnify, and hold us harmless from any claim arising out of (a) Customer Content you submit to AI Features, (b) your use of, or reliance on, any AI Output, or (c) your breach of section 6 or this section 7.
  • Permitted inputs. You must not submit to AI Features any data that you are not lawfully permitted to share with third-party processors, including but not limited to special-category personal data, regulated health, payment card, or government-issued identifier data, or content subject to confidentiality obligations that prohibit such sharing.

By enabling or using any AI Feature, you expressly acknowledge and accept the limitations described in this section. If you do not accept them, you must not use AI Features.

8. Subprocessors

We engage the following third-party subprocessors to deliver the Service. Each subprocessor is bound by written terms requiring appropriate security, confidentiality, and data-protection obligations. We may update this list from time to time; material changes will be communicated through the Service.

Our AI subprocessors are contractually prohibited from using your Customer Content to train their foundation models. Inputs and outputs may be retained transiently by AI subprocessors for abuse-monitoring purposes in line with their published policies, then deleted.

Requesting export or deletion of your data

You can export or delete most of your data yourself from within the Service:

  • Export — open any entity (project, feedback item, use case, etc.) and use the share / copy actions, or contact us for a full workspace export in JSON or CSV.
  • Delete a workspace — workspace admins can delete a workspace from Settings → Workspace, which removes all associated Customer Content from our primary systems within 30 days.
  • Delete your account — email info@thepm.app from your registered address to request account deletion. We will confirm completion within 30 days and instruct our subprocessors to delete copies held on our behalf in line with their retention schedules.
  • Billing data — Paddle holds invoice and payment records as the Merchant of Record and may retain them to meet tax and accounting obligations. You can request a copy or deletion via paddle.net.

For any data-rights request (access, rectification, restriction, portability, objection, withdrawal of consent), email info@thepm.app. We aim to respond within one month.

9. Service level

We work hard to keep the Service available and reliable, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

10. Payment, billing, and subscriptions

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms.

See our Refund Policy for details. Refund requests are handled by Paddle.

12. Suspension and termination

We may suspend or terminate your access to the Service for: (a) material breach of these Terms; (b) non-payment; (c) security or fraud risk; or (d) repeated or serious policy violations. On termination, your right to use the Service ends. You may export your data within a reasonable window after termination, after which it may be deleted.

13. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the Service — including any AI Feature and any AI Output — is limited to the fees you paid us in the twelve (12) months preceding the claim, or USD 100 if no fees were paid. We will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Service or any AI Output, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes liability for fraud, death, or personal injury caused by negligence where such exclusion is not permitted by law.

14. Indemnity

You agree to defend, indemnify, and hold harmless the PM app, its affiliates, and their personnel from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from (a) Customer Content you submit, (b) your use of the Service or any AI Output, (c) your violation of these Terms, or (d) your violation of any law or third-party right.

15. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.

16. Governing law

These Terms are governed by the laws applicable in the jurisdiction in which the PM app is established. Disputes will be resolved in the competent courts of that jurisdiction, unless otherwise required by mandatory law.
